NGOs and Investment Legislation in WTO System:Divergences,Reasons and Countermeasures

WTO体系内"与贸易有关"的投资规则和多边投资规则的谈判和实施因成员间的分歧和非政府组织的批评陷入困境。这其中既有WTO面临内外双重困境和投资立法饱受争议导致WTO体系内的投资议题更为敏感的原因,也存在国际经济政治格局变化、科学技术飞速发展和市民社会的不同诉求要求国际利益再平衡和国际机制再调整的深层原因。鉴于此,要深刻认识WTO困境和非政府组织反对的本质原因,坚持国际法治理念、维护国际法权威、倡导人类命运共同体价值、回应多方利益关切、结合中国国情、推动WTO体制规则改革。

The negotiation and implementation of"trade-related"investment rules and multilateral investment rules in the WTO system mire in difficulties because of dispute between members and criticism from NGOs.The reasons include WTO facing difficulties from both inside and outside and issues related to investments in the WTO system resulting from the controversial of investment legislation.In addition,it also has some deep causes.For example,the changes of international economy and politics structure,rapid development of technology,and different demands from civilians and society,which require the rebalance of international benefits and readjustments of international mechanisms.In view of this,we need to deep understand the difficulties of WTO and the essential causes of NGOs’opposition.Meanwhile,we should insist on the international rules of law,maintain the authority of international law,advocate the value of a community of shared future for mankind,respond to multi-stakeholder concerns by integrating Chinese national conditions,and promote WTO institutional rule reform.
