刑法学是我国部门法学当中最为显赫的学科,也是研究成果浩如烟海的学科。但是以刑法智慧树的形式对其内部构造进行研究却寥若晨星。关于刑法智慧树的内部结构,首先必须弄清刑法智慧树内部构造的根基、重心与全貌,因为这些问题关乎刑法的基本含义、法律特征与基本范畴等基础性问题。除与刑法本体有关的内容之外,犯罪与刑事责任是刑法学研究不可或缺的核心问题。在当今世界各国虽然存在大陆法系、英美法系与苏俄法系三大犯罪论体系,但是犯罪构成的四要件理论是我国刑法理论的通说,因此如何把握我国刑法的中国特色,是我们每一个刑法理论研究工作者必须担负的历史使命。鉴于此,有关刑法智慧树的内部构造及其体系的展开,必须同时关注我国刑法中犯罪概念的基本内涵、犯罪构成的相关理论以及犯罪的法律后果并对其作出正确的解读。

Criminal law is the most prominent subject in our country's departmental law,and it is also a subject with vast research results.However,there is very little research on its internal structure in the form of the criminal wisdom tree.Regarding the internal structure of the criminal wisdom tree,we must firstly clarify the foundation,focus and overall picture of the internal structure of the criminal wisdom tree,because these issues are related to the basic meaning,legal features and basic categories of criminal law.In addition to the issues related to the criminal law,crime and criminal liability are indispensable core issues in the study of criminal law.Nowadays,although there are three major criminal theories which are the civil law system,the common law system and the Soviet Russian law system in the world,the four elements of crime constitution are the general theory of China's criminal law theory.Therefore,how to grasp the Chinese characteristics of China's criminal 1aw is a historical mission that every criminal law theoretical researcher must undertake.In view of this,regarding the intemal structure of the wisdom tree of criminal law and the development of its system,we must pay attention to the basic connotation of the concept of crime,the related theories of crime constitution and the legal consequences of crime in the criminal law of our country,then make a correct interpretation of these.
