当前我国新闻媒体报道未决刑事案件缺乏尺度与配套机制,易对犯罪嫌疑人的基本权利造成侵害。需要平衡背后体现的新闻媒体报道的公益需要与犯罪嫌疑人基本权利保护的价值冲突。应当引入比例原则协调冲突。以比例原则的适合性、必要性和相称性及延伸的法律保留原则为指导把握报道的尺度。坚持报道的三个标准:基本人权底线、公益适合与必要及未决案件严重性、诉讼阶段、被证实程度的报道相称性。在此标准下构建配套保障机制:制定新闻法规、实施司法许可、建立被遗忘权诉讼机制、制定新闻媒体报道参考指引及建立合规与刑辩律师审核机制。

At present,China’s news reports that there are no standardized about criminal cases,which may easily infringe on the basic rights of criminal suspects.Behind the value conflicts between the needs of public welfare and the protection of the basic rights of criminal suspects,the principle of proportionality should be introduced to coordinate conflicts.The suitability,necessity and proportionality of the principle of proportionality and the extended legal retention principle are the guiding measures for grasping the scale of the report.Adhere to the three criteria of reporting:human rights bottom line,public welfare suitability and necessity,and the seriousness of pending cases,litigation stage,and the degree of conformity reported.Under this standard,a supporting guarantee mechanism will be established:formulating news regulations,implementing judicial licenses,establishing forgotten rights litigation,formulating guidelines for media reports,and establishing compliance and criminal defense lawyer review mechanisms.
