互联网涉毒犯罪司法适用问题探析

互联网涉毒犯罪之严峻形势和严重社会危害性,对司法适用提出了新的挑战和要求,精准、严厉打击互联网涉毒犯罪的专门司法解释亟待出台。无论是利用互联网传播制毒方法行为,还是利用互联网居间介绍买卖毒品行为,抑或利用网络平台组织吸毒行为,都需要结合其具体行为样态进行类型化分析。在此基础上,应尽快研拟制定专门指导办理互联网涉毒犯罪案件适用法律问题的司法解释,为互联网涉毒犯罪确立有别于传统毒品犯罪案件的定罪量刑标准。

The severe situation and serious socialharmfulness of Internet drug-related crimes put forward new challenges and requirements for judicial application,and the special judicial interpretation to crack down on Internet drug-related crimes accurately and severely needs to be introduced.It is necessary to carry out typological analysis in combination with specific behavior patterns whether it is to spread methods of producing drugs through the Internet,to use the Internet to introduce drug trafficking,or to organize drug taking through network platforms.On this basis,it is significant to develop a judicial interpretation as soon as possible to guide the handling of Internet drug-related crimes,so as to establish the conviction and sentencing standard for Internet drug-related crimes,which should be different from traditional drug-related crimes.
