摘要
法律授权逻辑确立的初衷在于化解救济路径难题,却延伸至高校学位授予标准的实体合法性判断,不但未能澄清授权的意涵,而且对法律授权与学术自治的关系予以模糊处理。从国家行政权的角度来理解法律授权,意图通过法律保留与比例原则来建构高校学位授予标准的正当性,忽视了法律授权的内在界限,混淆了法律授权与学术自治的关系,导致司法审查的约束变松。法律授权难以借助法教义学来形塑对高校学位授予标准的约束,在行政主体制度得以根本变革之前,学位立法应当赋予学术自治独立价值,并确立程序和实体原则来监督学术自治。对高校学位授予标准的司法审查同样应当遵循程序合法性与实质合法性的双重标准。
The original purpose of legal authorization logic is to solve the problem of relief path,which is expand to the substantive legitimacy judgment of degree awarding standards.This approach fails to clarify the meaning of legal authorization,and fuzzily deals with the relationship between legal authorization and academic autonomy.Understanding legal authorization from the perspective of national administrative power,and controlling university regulations in degree awarding through legal reservation and the principle of proportion,ignore the internal boundary of legal authorization,confuse the relationship between legal authorization and academic autonomy,and lead to the deregulation of judicial review.It is difficult for legal authorization to shape constraints on university regulations in degree awarding with the help of legal dogmatics.Before the fundamental reform of the administrative subject system,degree legislation should endow academic autonomy with independent value and establish procedural and substantive principles to supervise academic autonomy.The judicial review of university degree awarding standards should also follow the double standards of procedural legitimacy and substantive legitimacy.
