Explanation and Commentary on ZhuYuanzhang’s View of Supervisory Legal System

明太祖朱元璋高度重视监察制度建设,就监察机构的地位、性质及其与其他国家政权机关的关系,监察机构和官员的职责任务,监察官员的选拔、任用、管理等方面都提出了自己的主张和观点,形成了比较系统的监察法制观,标志着我国古代政治家对监察法制发展规律的认识上升到了一个新的高度。考察朱元璋的监察法制观对于深化明初乃至有明一代的监察法制研究具有重要价值。

Zhu Yuanzhang,the first emperor of the Ming Dynasty,attached great importance to the construction of the supervisory system and put forward his own propositions and views on the status and nature of supervisory institutions and their relationship with other organs of state power,the duties and tasks of supervisory institutions and officials,and the selection,appointment and management of supervisory officials,thus forming a relatively systematic view of the supervisory legal system.Zhu Yuanzhang’s view of supervisory legal system,which had an important and far-reaching influence on the supervisory legal system in the early Ming Dynasty and even in the entire Ming Dynasty,indicates that ancient politicians in China had reached a new height in understanding the development law of the supervisory legal system and has certain enlightening significance and reference value even for us today in strengthening the construction of the supervisory legal system.
