Theory of Governing by Law in Xi Jinping’s Thought on Rule of Law

在习近平法治思想的体系中,依法执政理论贯穿始终、牵涉各方。习近平总书记关于依法执政的论述,内容丰富、立意深远,体现了对党的十六大以来依法执政理论的总结、发展、创新和升华。习近平法治思想中的依法执政理论一方面通过"三统一、四善于",强调了依法执政之于党的领导的重要意义,另一方面则明确提出了依宪执政是依法执政的关键,建立了"依法治国、依法执政、依法行政共同推进"的逻辑体系。除了一系列重大的法治意义,习近平法治思想中的依法执政理论还强化了"以人民为中心"的原则,构成了国家治理现代化的重要动力,并有助于落实全面从严治党。以习近平法治思想为指导,应当从党的领导法治化、法治国家一体建设、国家权力属于人民三个视角切入,进一步从理论上深化和细化依法执政理论。

In the system of Xi Jinping thought on rule of law,theory of law-based administration runs through and involves all parties.General secretary Xi Jinping’s exposition on law-based administration is rich in content and far-reaching in conception,which is the summary,development,innovation,and sublimation of the theory of administration according to law since the Sixteenth CPC National Congress.On the one hand,it stresses the importance of ruling by law in the leadership of the party through"three unification and four good";on the other hand,it clearly points out that the key to ruling according to the constitution is to establish the rule of constitution,which form the logic system of"ruling the state according to law,the party in power following law,and administrating the state according to law".In addition to a series of significant influence on rule of law,Xi Jinping theory on rule of law has also strengthened the principle of"taking the people as the center",which has constituted an important driving force for the modernization of national governance,and is also conducive to the implementation of a comprehensive strict administration of the party.Under the guidance of Xi Jinping thought on rule of law,we should further deepen and refine the theory of ruling according to law from the following three perspectives:the party’s leadership governed by law,an integrated construction of a state ruling by law and state power vesting in people to further deepen and refine the theory of law-based administration.
