中国公共卫生统合式立法的法理与策略

Jurisprudence and Strategy of China’s Integrated Public Health Legislation

统合式立法是有效解决公共卫生立法碎片化及法律冲突问题,弥补公共卫生立法短板与不足的基本路径。中国公共卫生立法遵循国内外公共卫生法理内含的客观规律,以人民生命安全与公共健康保障为价值追求,以公共卫生法律法规衔接协调为战略重心。在统合式立法的整体主义法理逻辑下,优化中国公共卫生治理的法治结构,应以公共卫生基本法统领新发传染病与再发传染病防治二重原则的确立,以健康影响评价制度与应急管理程序设置统合公共卫生应急法治建设,以准用性规则推动公共卫生立法与民法典的有效衔接,形成推动公共卫生立法体系化发展的立体结构,为人民的生命安全、健康和美好未来保驾护航。

Integrated legislation is the basic way to effectively solve the fragmentation of public health legislation and conflict of laws,China’s public health legislation follows the objective law of public health Jurisprudence at home and abroad,takes public health security as the value pursuit,and takes the coordination of public health laws and regulations as the strategic focus.Under the logic of holism,we should optimize the rule of law structure of public health governance in China,establish the dual principles of prevention and treatment of new and recurrent infectious diseases with the basic law of public health,integrate the legal construction of public health emergency with the establishment of health impact assessment system and emergency management procedures,and promote the effective development of public health legislation and civil code with the applicable rules to form a three-dimensional structure promoting the systematic development of public health legislation,protecting people’s life safety,health and a better future.
