国家治理理念下法治政府建设的再思考——基于文本、理念和指标的三维分析

Rethinking Building a Rule of Law Government in the Idea of China’s Governance

法治政府建设是非常复杂的社会行动系统,牵涉多元主体、多项制度和大量资源。国家治理理念指导下的法治政府建设更是一项特别强调整体协同的系统工程。整体性的理论分析对新时代法治政府建设的意义重大。本文从社会行动系统的AGIL功能模式视角出发,基于文本、理念和指标对法治政府建设进行了整体性的分析。从环境的关系模式来看,法治政府建设可分为"依法"、"倚法"和"一体"建设三个阶段。三个阶段分别以严格法治概念、善治观念和国家治理理念作为其整合性的理念。作为建设理念的行动指导和建设成效的评价标准,法治政府建设指标体系必须具有科学性、系统性和适应性。文章结合国家治理理念的要求,对当前法治政府建设指标体系提出了一些具体的完善建议。

To build a rule of law government is a social action system which is so complicated that involved multiple subjects,multiple systems and a large number of resources,especially in the leadership of the idea of China’s governance.Thus,a theoretical analysis with an overall view is of great significance.This paper makes a whole analysis on the construction of a rule of law government in our country which is based on documents,idea and index,and from the perspective of AGIL function model of social action system at the same time.From the perspective of environmental relations,the construction of a rule of law government can be divided into three stages:"law-based","leaning on the law"and"integrated".The three stages respectively take the concept of strict rule of law,the concept of good governance and the concept of national governance as their integrated concept.As the action guidance of the construction idea and the evaluation criterion of the construction effect,the index system of the construction of the government by law must be scientific,systematic and adaptive.According to the requirements of the national governance concept,this paper puts forward some concrete suggestions for improving the current law-based government construction index system.
