民初大理院民法“法理”的司法运用

“法理”作为判决依据和司法说理意义上的民事审判之“法源”,主要表现为正义、衡平之伦理与一般意义上的法律原则与法律理念等,是大理院民事审判中一类重要的法源。其作为民事司法判决依据,存在直接作为核心规范法源、与其他规范意群一同加强论证的规范法源之分。大理院通过参酌国情对法理规范进行制度性要素的转换、加强概念解释以及以保持民族性与推进社会进步为价值基础统合法理规范等方式来实现“法理”在司法领域的继受与整合。“法理”在大理院民事审判中的运用应注意严格限定其适用的程序和顺位条件,加强司法论证。此外,该运用对现代民事司法具有重要经验意义,要注重确立法理这一法源,并有望藉此来优化立法结构,实现良法善治。
