宪法学自主知识体系的三个衡量维度

The Three Evaluating Dimensions of the Independent Knowledge System of Constitutional Law

构建“自主”的宪法学知识体系一直是宪法学术共同体的理论自觉。反思和评判宪法学知识体系的自主性,应该超越单一的知识来源视角,深入到知识体系形成的内在机理,从知识的实践性、历史性、开放性、普遍性特质出发,做出立体、系统的分析。作为宪法知识的整合形态和生产形态,宪法学知识体系“自主性”存在多种分析维度,其中三种维度是基本的,即实践之维、历史之维、宪法文明之维。“建构”宪法学自主知识体系不是推倒重来,而是在现有基础上的完善;不是在一张白纸上重构,而是在现有知识基础上继续前行。宪法学理论只有在实践中做到“为我所用”“为我所有”“为他所用”,才能够以“不忘本来、吸收外来、面向未来”的胸襟成长为成熟的自主知识体系。

Constructing the"independent"constitutional law knowledge system has always been the theoretical consciousness of the constitutional academic community.Introspection and judgment of the autonomy of constitutional law knowledge system should transcend the perspective of a single source of knowledge,go deep into the internal mechanism of the formation of the knowledge system and make a three-dimensional and systematic analysis starting from the practical,historic,open and universal characteristics of knowledge.As the integration form and production form of constitutional knowledge,the"autonomy"of constitutional law knowledge system has a variety of analytical dimensions,among which three dimensions are basic,namely:the dimension of practice,the dimension of history and the dimension of constitutional civilization."Constructing"the independent knowledge system of constitutional law is not overturned,but perfected on the existing basis;not reconstructed on a blank sheet of paper,but continued forward based on the existing knowledge.Only in doing"for my use","for me"and"for others"in practice can constitutional theory"remember the original,absorb the foreign,and face the future"grow into a mature independent knowledge system.
