环境法典编纂的基本问题

环境法典编纂研究进入立法机关工作计划,理论研究为立法决策者提供理论支撑与具体编纂方案已经成为当务之急。有习近平生态文明思想和习近平法治思想作为坚定的政治基础和强大的理论武装,有构建现代环境治理体系的新目标、新任务对编纂环境法典提出的现实需求,有环境立法矛盾冲突、缺乏体系性而产生的环境法典编纂内生动力,有多年环境立法及法典化研究所达成的学术共识为编纂环境法典奠定理论基础,环境法典编纂条件已经成熟。可在行政立法领域法典的基本定位基础上,以可持续发展为核心价值,以“生态环境”为基石概念,以法律关系为技术工具,选择“适度法典化”模式,构建“总则——分编”框架结构,确定规范内容。

The research on the compilation of environmental code has entered the working plan of the legislature.It has become an urgent task for theoretical research to provide theoretical support and specific compilation plan for legislative decision-makers.With Xi Jinping thoughts on ecological civilization and the rule of law as firm political foundation and strong theoretical support,the existence of realistic demands for the codification created by the new goals and tasks of the modern environmental governance system,the existence of internal incentives for codification created by the legal contradictions and lack of systematization,and the existence of academic consensus reached through legislative experience and research on codification,the conditions for the compilation of environmental code have been mature.On the basis of the positioning as a code in the field of administrative law,the codification should take sustainable development as the core value,the concept of"ecological environment"as the cornerstone,and legal relations as the technical tool.We shall choose the"moderate codification"model to build the framework of"general provisions–specific chapters"and to determine the content of the code.
