社群视角下的国际数据法治理论发展与我国的回应

The Development of International Data Governance Theory and the Response of China from Community-Social Space Perspective

目前国际数据治理面临理论供给不足的束缚,导致规则层面的统一难以推进。现有理论主要立足于数据主权理念和"知情同意"、"场景一致性"、"分级分类保护"等一般数据法治理念的协调,理念运用不足以解决规则发展的最根本障碍——利益分歧。"网络空间命运共同体"理念的内核鲜明揭示了应将与人类在网络空间共同命运息息相关的利益置于重要地位,并指引了利益协调的可能前景。以"共同体"为衔接,我们可以引入社会学的"社群—社会空间"范式,强化"网络空间命运共同体"理念下的价值位阶阐释,形成符合我国及全人类利益,并可应用于具体场景的国际数据法理方案。

At present,international data governance is constrained by insufficient theoretical supply,which makes it difficult to promote the unification of rules.Existing theories are mainly based on the coordination between the concept of data sovereignty and the ideas of general data governance by law such as"informed consent","contextual integrity"and"protection by classification and categorizing",and the application of the concept is not enough to solve the most fundamental obstacle to the development of rules--the divergence of interests.The essence of the concept of"community of shared future for mankind"is to make clear that certain interests related to the common destiny of mankind should be placed in an important position.It does not only provide an idea,but more importantly,also guides the possible prospect of interest coordination.With"community"as a link,we can introduce the paradigm of"community-social space"in sociology,strengthen the interpretation of value hierarchy under the concept of"community of human destiny",and form an international data jurisprudence scheme that conforms to the interests of China and all mankind and can be applied to specific scenarios.
