The Coherent Promotion of the Domestic Rule of Law and the Foreign-related Rule of Law

"坚持统筹推进国内法治和涉外法治",是习近平法治思想的重要组成部分,对新时代推进全面依法治国具有重要意义。全面准确理解和践行"坚持统筹推进国内法治和涉外法治"的核心要义,需要从具体内容、工作重心以及重大意义三个方面展开。在统筹推进国内法治和涉外法治建设中,国家始终是推进国内法治和涉外法治的主体。国内法治和涉外法治是中国法治的两个方面,在国内法治和国际法治之间,涉外法治发挥着桥梁纽带、互动融通的作用,并促进国内法治与国际法治相互影响和共同发展。我们应高度重视推进涉外法治的战略意义,并将其作为统筹推进国内法治和涉外法治的工作重心。我国需要将构建和完善中国对外关系法体系、编纂与《民法典》相关联的中国国际私法典、强化涉外法治人才的培养,作为当下坚持统筹推进国内法治和涉外法治的着力点。在国际法治面临单边主义、报复主义和逆全球化的诸多挑战之情势下,中国应积极参与全球治理体系变革,推动更为公平合理国际规则的形成,坚持多边主义,强化国家间合作,增强中国优秀文化和制度的吸引力和影响力。

As the key components of Xi Jinping Thought on the Rule of Law,the coherent promotion of domestic rule of law and foreign-related rule of law plays an important role in comprehensively advancing law-based governance in the new era.The policy of promoting the coherent development of domestic rule of law and foreign-related rule of law need to be understood and carried out from three perspectives,concrete content,priorities and key role.The State is the subject in promoting the coherent development of domestic rule of law and foreign-related rule of law.Domestic rule of law and foreign-related rule of law are two aspects of rule of law in China.Between domestic rule of law and international rule of law,foreign-related rule of law plays a bridging and interactive role.Great emphasis has to be placed on the strategic significance of promoting the foreign-related rule of law,which is the focus of the coherent promotion of domestic rule of law and foreign-related rule of law.Therefore,constructing and improving foreign relations law system in China,codifying Chinese Private International Law in relation with the Civil Code,and strengthening the cultivation of legal experts in foreign affairs should be the current key points.While international rule of law is confronted with many challenges such as unilateralism,revenge and de-globalization,China should actively participate in the transformation of the global governance system,promote the formation of a more fair and reasonable international rules,adhere to multilateralism,strengthen the cooperation among countries,and enhance the attraction and influence of Chinese outstanding culture and system.
