论商标权滥用的信用规制 被引量:5

On the Credit Regulation of Trademark Right Abuse

摘要 由于商标法律制度的局限和当前司法、执法存在的困境,多年来中国的商标恶意抢注和恶意囤积等商标权滥用行为屡禁不止。2019年4月修正的新《商标法》增加了第4条和第68条,力图从商标注册规范化的角度限制商标权滥用的可能。但这些规定的具体适用尚不明确,相关适配机制还未完善。从新《商标法》颁布之后中国商标申请数量的继续增长来看,该法的修正并没有从根本上遏制商标权的滥用。通过对《商标法》修正所体现的立法意涵及“诚”“信”关系的辨析,发现商标权滥用其实质是严重了违背商业伦理,是一种失信行为,因此,只有对市场主体的商标权滥用现象进行信用规制才是治理该问题的治本之策。文章所阐述的观点不止为解决商标权滥用问题提出了新思路,更为解决中国社会中严重悖德行为的信用规制提供了理论基础。 Due to the limitations of the trademark legal system and the current difficulties in judicial and law enforcement,the abuse of trademark rights such as malicious registration and hoarding of trademarks in China continues despite repeated prohibitions.Aiming for this kind of condition,the new“Trademark Law”revised in April 2019 added Articles 4 and 68,trying to limit the abuse of trademark rights from the perspective of the standardization of trademark registration.However,the specific application of these regulations is not yet clear,and the relevant mechanisms to adapt to them are not yet complete.Judging from the continued increase in the number of trademark applications in China after the promulgation of the new“Trademark Law”,the promulgation of the law has not fundamentally curbed the abuse of trademark rights.Through the analysis of the legislative meaning and the relationship between“honest”and“trust”embodied in the amendment to the“Trademark Law”,the article believes that the essence of trademark abuse is an act of dishonesty.Only credit regulation of market entities’abuse of trademark rights is the fundamental policy to solve this problem.
