环境法体系合宪性审查的原理与机制

为了确立环境法在法律体系中的独立地位、解决环境法体系内部概念和规范不一致的问题,我们需要对环境法体系进行合宪性审查以实现环境法体系质效的提升。环境法体系的合宪性审查,除了审查环境法体系可能的宪法性瑕疵,更主要的是在遵循宪法依据的基础上,全面实施宪法规范,实现宪法和环境法规范的交互影响及体系性融贯。通过程序与实体相结合、技术与内容相结合、体系和条款相结合以及审查和融贯相结合,厘清环境法体系与宪法的关系,明晰环境法体系中基础性概念内涵,趋使环境法体系及制度更科学合理,实现环境法体系的分类科学化、事项完备化以及制度实效化,打造以宪法为直接依据、环境基本法和环境部门法梯级分明的环境法体系,在宪法与环境法规范的交互影响乃至体系性融贯的基础上既发展环境法也发展宪法。

In order to establish the independent status of environmental law departments in the legal system,solve the problem of inconsistent concepts and norms within the environmental law system,so as to achieve the qualitative improvement of the environmental law system,it is necessary to carry out constitutional review.The constitutional review of the environmental law system refers to the implementation of constitutional norms on the basis of following the constitutional basis,so as to realize the interaction and systematic coherence between the Constitution and environmental law norms.Through the combination of procedures and entities,technology and content,systems and provisions,and review and coherence;to clarify the relationship between the environmental law system and the Constitution,to elucidate the important categories of the environmental law system,and to make the environmental law system and institution more comprehensive and reasonable,so as to realize the scientific classification,complete matters and effective system of the environmental law system;to establish an environmental law system with the Constitution as the direct basis,and a clear hierarchy of environmental basic law and environmental sector laws;on the basis of the interaction between the Constitution and the norms of environmental law and even the systematic coherence,both environmental law and the Constitution are developed.
