我国未成年人网络安全风险及其防范措施的完善

China’s Minors Network Security Risks and the Improvement of Preventive Measures

网络时代未成年人面临的网络安全风险日益增多,例如个人隐私泄露、网络不良信息影响、网络游戏沉迷等。与此同时,权利的保护显得更为重要,《未成年人保护法》修订增加了"网络保护"一章。但其制度设计存在如下不足,例如,网络安全风险规制不足、不良信息范围的界定不周全、未成年人权益最大化原则未能体现等。对未成年人的网络保护应有整体制度设计,强化多元主体协同治理、线上与线下结合治理以及系统治理的原则。因此,需要在推行更为科学的网络实名制、建立未成年人个人信息与隐私的特别保护制度、明确网络服务商或运营商提供网络内容的限制制度、强化网络行业组织的治理功能以及健全网络保护的技术措施方面进一步加以完善。

In the Internet age,minors are facing more and more network security risks,involving personal privacy leakage,the impact of bad network information,online game addiction and so on.At the same time,the protection of rights is more important.The minor protection law has been revised and a chapter of"network protection"has been added.But its system design has the following deficiencies,such as the lack of network security risk regulation,the incomplete definition of the scope of bad information,and the failure to embody the principle of maximizing the rights and interests of minors.The network protection of minors should be designed as a whole system,and the principles of multi subject collaborative governance,online and offline combined governance and system governance should be strengthened.Therefore,we need to carry out more scientific network real name system,establish a special protection system of minors’personal information and privacy,clarify the restriction system of network content provided by network service providers or operators,strengthen the governance function of network industry organizations,and improve the technical measures of network protection.
