法教义学在中国:历程、疑问与反思

摘要 法教义学在中国具有独特的发展历程,在继受过程中也产生了诸多中国式疑问。在中国,法教义学起步于“局外人”批判,成型于与社科法学的论战,并因多种关联性研究的兴起而壮大。围绕法教义学形成的“中国之问”主要包括性质之问、功用之问和普遍性之问。这些疑问的产生或者是源于“跨语际实践”中的中国式联想,或者是因为过于轻视法教义学的功效或忽视其功效的限度,或者是出于对学术自主性与开放性之关系的误解。目前对法教义学的定位也存在片面理解或者误区。在澄清这些疑问的同时必须指出,中国的法教义学研究与司法实践之间仍比较疏离,研究的成熟度在各法律领域的差异较为明显,法教义学概念构造和知识体系化的自主能力尚有不足。这些问题都需要在未来的发展过程中逐步予以解决。 The legal dogmatics in China has its own unique development trace,and there have also arisen many Chinese-style doubts in the process of transplantation.It is originated from the criticism of“outsiders”,took shape in the polemics with social science and law,and grew out of the prosperity of several relevant studies.The“Chinese Questions”surrounding legal dogmatics can mainly be classified into three groups,i.e.,the question of nature,of function and of universality.These doubts either arose from Chinese-style associations in“cross-linguistic practice”,or because of over-contempt for its efficacy or over-looking the limits of that efficacy,or due to misunderstandings about the relationship between academic autonomy and openness.At present,there is also a one-sided understanding or confusion about the location of legal dogmatics.While clarifying these doubts,it must also be pointed out that Chinese legal dogmatics study still departs away from judicial practice,the differentiation of maturity of legal dogmatics study is obvious in various legal fields,and the autonomous ability of doctrinal conceptual construction and systematization of knowledge is still insufficient.These problems need to be gradually resolved in the future development.
