怎样发现宪法精神?

习近平总书记在《谱写新时代中国宪法实践新篇章——纪念现行宪法公布施行40周年》一文中明确提出“宪法精神”概念。宪法精神对当代中国宪法的实施具有重大的意义,但理论和实践中不宜泛化使用“宪法精神”概念,要在揭示宪法文本中宪法规定、宪法原则背后蕴涵的宪法原理的基础上,运用宪法解释的方法,通过明确宪法文本中宪法规定之间、宪法规定与宪法原则之间以及宪法原则与宪法原则之间的价值关系,来“发现”宪法精神。科学和有效地“发现”宪法精神,有助于进一步丰富和发展宪法文本中宪法规定和宪法原则的内涵,提升宪法作为立法依据和合宪性审查依据的确定性,推动宪法实施水平的不断提高和宪法学概念体系的不断完善。

General Secretary Xi Jinping clearly proposed the concept of“constitutional spirit”in his article“Composing a new chapter of Chinese constitutional practice in the new era-Commemorating the 40th anniversary of the promulgation and implementation of the current Constitution”.The concept of“constitutional spirit”should not be generalized.On the basis of revealing the constitutional provisions and principles contained in the constitutional text,it is necessary to use the method of constitutional interpretation to“discover”the constitutional spirit by clarifying the value relationship between constitutional provisions and provisions,between constitutional provisions and principles,and between constitutional principles and principles in the constitutional text.Scientifically and effectively“discovering”the spirit of the Constitution helps to further enrich and develop the connotation of constitutional provisions and principles in constitutional texts,enhance the certainty of the Constitution as a legislative basis and a basis for constitutional review,and promote the continuous improvement of the implementation level of the Constitution and the continuous improvement of the constitutional concept system.
