良知作为法律人的世界观和实践方法论的意蕴

善治是新时代法律职业理论的背景框架。公正对待和尊重他人是法律职业伦理的基础,也是法律职业道德的核心内容。法律职业伦理的目的是在法律职业活动中将法律人的实践判断与良知结合在一起。正是法律人的这种善良目的,法律职业道德的“标准基础”才能得到证成。法律职业者的德性是指,能将法律职业行为诉诸某些超越或高于法律规范本身的权威资源,比如善良理念、法律智慧、道德良知等。法律职业伦理在本质上是一种观念化的存在,伦理意味着良知和责任。法律职业者需要培养良知意识,良知意识具有道德直觉的特点,表现为一种自觉的认知和能力。在法律职业的实践中良知具有优先的地位。良知体现法律职业者的世界观,法律职业的活动展现法律人的实践方法论。世界观是种立场,而方法论是种途径。世界观决定方法论,法律职业的世界观决定了法律职业主体行为的具体实践方法论。
