From the Internet Law to the Internet Judicial System:Multi-dimensional Interactions in the Evolution of Technology and Norms

互联网技术的发展,带来互联网治理的变迁。早期的互联网更多体现出内在的规范与秩序,此后国家法更有力地介入其中进行外在规制,并进一步通过互联网司法的形成和发展与互联网更深入融合。在规范约束技术的同时,技术也在重构规范,网络空间中人工智能技术的广泛运用,导致算法形成了规范性特征。当算法成为一种规范之后,法律与算法之间的互动,体现出类似法律与社会规范之间的竞争与合作并存的关系,但也因网络空间的特征而体现出不同的模式。互联网治理中的规范竞争,一个关键的变量是信息成本,技术变迁对于信息成本的重构,可能会导致社会治理规范体系的重构。

The development of internet technology brings about the change of internet governance.The early internet is governed mainly by the internal norms and order,hereafter the Internet is more and more regulated by the laws of state.The development of internet law further prompted the formation of internet judicial system,which means the in-depth integration between internet and law.At the same time of the technology is regulated by the norms,the norms are also reconstructed by the technology.The extensive application of artificial intelligence technology in the network space leads to the formation of normative characteristics of the algorithm.When algorithm becomes a kind of norms,the interaction between law and algorithm reflects the coexistence of competition and cooperation similar to that between law and social norm,but also reflects different patterns due to the characteristics of cyberspace.In the internet governance,a key variable is the information cost.The reconstruction of information cost caused by the technological change may leads to the reconstruction of social governance norms system.
