元宇宙临界的思考:“混合世界”的社会系统与法律

Thinking on the Meta-universe's Criticality:Social Systems and Law in a“Mixed World”

元宇宙临界重塑了人们对虚拟与现实的认知,让一个全新的“混合世界”更加真实地被个体感知,并以对未来景象的擘画产生了社会系统变迁的动力。这种动力源于行为体系统、制度体系(结构)与物理环境等诸要素的同步演化。而行为体对演化中新观念力量的学习、建构与选择则是社会系统变迁的内在机理。基于此,当预设以发展为价值导向时,固化的观念容易使行为体停留于不断重复的旧安全命题,并构成对社会系统发展的惰性和阻力。在面对因固化观念与新观念力量互动所产生的张力时,为了实现“混合世界”社会系统的稳定性变迁,亟须一种开放、统合的法律策略去保障系统的韧性。以技术为视角,立足于具有本体意义的物理环境思考法律对策尤为必要:一是法律不应被作为工具以强制性制度变迁的手段去引导范式革命,而是尊重技术变迁的自我衡平,以法律符号的技术化保障技术变迁到制度化的第一步跨越;二是法律应以边界机制与时间机制为手段,保障技术在改造物理环境过程中的空间正义,为行为体选择权限制设置一些空间底线。

Meta-universe critical reshapes people's cognition of virtual and reality,makes a new“mixed world”more truly perceived by individuals,and draws the dynamics of social system changes by drawing the future landscape.This kind of power originates from the synchronous evolution of the factors such as the actor system,the institutional system(structure)and the physical environment.The learning,construction and selection of new ideas are the internal mechanism of social system change.Based on this,when the presupposition takes development as the value orientation,the solidified concept tends to make the actors stay in the old security proposition which is repeated constantly,and constitutes inertia and resistance to the development of the social system.In the face of the tension generated by the interaction of solidified ideas and new ideas,in order to achieve the stability and change of the social system in the“mixed world”,an open and integrated legal strategy is urgently needed to ensure the resilience of the system.From the perspective of technology,it is especially necessary to think about legal countermeasures based on the physical environment with ontological significance:First,law should not be used as a tool to guide paradigm revolution by means of mandatory institutional change,but respect the self-equity of technological change and ensure the first step of technological change to institutionalization with the technicalization of legal symbols;Second,the law should take the boundary mechanism and the time mechanism as the means to ensure the spatial justice of technology in the process of transforming the physical environment,and set some space bottom line for the restriction of the choice of actors.
