摘要
从法学角度观察国家能力离不开对信息的关注。新冠肺炎疫情催生了对大规模社会主体行为信息的需求,为建设新的认证基础设施提供了契机,因此,基础身份是不断变化和调整的。不同颗粒度的信息使用是一个逐渐调整的过程,最终会帮助催生出因人而异的规则形态和执行过程,但前提仍然是具有统一标准的规则要求和基础信息的普遍获取。信息基础设施存在的主要目的是便利社会主体和其他要素的流动性,但其本身不能决定流动性高低,该设施的效能与其他配套的线下基础设施和组织模式等因素密切相关。在提升国家信息能力的过程中,信息认证需要嵌套在整个信息生产、使用和配套机制中,和整个制度与资源能力相匹配,否则难以实现精准功效。
Observing national capacity from the perspective of law can not be separated from the attention to information.The COVID-19 has expedited the demand for behavior information of large-scale social subjects,and provided an opportunity for the construction of new certification infrastructure.Therefore,the basic identity is constantly changing and adjusting.The use of information with different granularity is a process of gradual adjustment,which will eventually help to give birth to rule forms and implementation processes that vary from person to person,but the premise is still the rule requirements with unified standards and universal access to basic information.The main purpose of the existence of information infrastructure is to facilitate the mobility of social subjects and other elements,but it cannot determine the level of mobility itself.The efficiency of the facility is closely related to other supporting offline infrastructure and organizational models.In the process of improving national information capacity,information authentication needs to be nested in the entire information production,use and supporting mechanism,and match the entire system and resource capacity,otherwise it will be difficult to achieve accurate efficacy.
