互联网平台反垄断案件处理的一大难题在于如何准确界定相关市场,相关市场的界定影响市场范围和互联网平台在该相关市场支配力大小的认定。由于互联网平台具有不同于传统企业的双边市场、交叉网络外部性、免费定价策略和平台产品的同质性等特征,导致认定传统企业相关市场的方法难以适用于互联网平台。本文通过对传统企业市场支配地位认定思路的分析,得出其在界定相关市场时暗含着以支配力来源为视角界定相关市场的思路。通过对具有负网络外部性的互联网平台的分析,以支配力来源为视角,将相关市场分为主要市场和次要市场,从而将支配力来源市场界定为互联网平台在判断市场支配地位时的相关市场。
The difficulty of dealing with antitrust cases about internet platform is how to precisely define the related market.The definition of the related market has influence in the definition of the range of market and the dominance of Internet platform in the related market.Due to the characteristics of the Internet platform that are different from traditional enterprises,such as the characteristics of twosided market,cross network externality,the strategy of free and the homogeneity of platform products.It is difficult to apply the method of identifying the related market of traditional enterprises to Internet platform.Through the analysis of the definition of traditional enterprises’dominance in related market,it is concluded that the definition of the related market implies the idea of defining the related market by the source of dominance.Through the analysis of Internet platforms with negative cross network externality,from the perspective of the source of dominance,the related market can be divided into primary and secondary markets.Defining the market that the source of dominance as the related market where the Internet platform has dominance.
