论组织出卖人体器官罪之“组织行为”

On the "Organizational Behavior" of the Crime of Organizing the Sale of Human Organs

“组织行为”是组织出卖人体器官罪的实行行为,不应当对“组织行为”作扩大解释,本罪中的“组织行为”仅指组织器官出卖者出卖人体器官的行为,且不应当包含暴力手段。被组织者只能是器官的出卖者,即本罪的被害人。“组织行为”仅就出卖人体器官而言,组织收购人体器官与组织出卖人体器官并不具有同等的刑罚当罚性。结合法条规定和刑罚设置,组织者实施“组织行为”所引发的具有刑法意义上的危险结果是本罪处罚的基础,此时介入刑法规制是遵循罪刑法定和罪责刑相适应原则保护法益的需要。实质危险性是“组织行为”所造成的危害结果,组织出卖人体器官罪应当属于结果犯,“组织行为”的完成具有构成要件该当性,当行为对被害人身体法益造成实质危险结果时犯罪既遂。

"Organizational behavior"is the act of perpetrating of the crime of selling human organs by organizations,which shall not be interpreted in an expanded way.In this crime,"organizational behavior"shall only refer to the behavior of organ sellers selling human organs without violent means and the organized person shall only be the organ seller,that is,the victim of this crime."Organizational behavior"is only related to the sale of human organs.Therefore,the two acts of purchasing human organs by organizations and selling human organs by organizations shall not have the same penalty.According to the provisions of the law and the setting of punishment,the dangerous results in the sense of criminal law caused by the organizer’s organizational behavior are the basis for the punishment of this crime.Therefore,the intervention of criminal law regulation is necessary to protect the legal interest in accordance with the legal principle of crime and punishment and the principle of suiting punishment to crime.Substantial dangerousness is the harmful result caused by organizational behavior.The crime of selling human organs by organizations shall be the consequential offense.Therefore,it shall be accomplishment of a crime when the completion of the organizational act has the proper constitutive requirements and causes substantial dangerous results to the victim’s legal interests.
