2018年5月21日广州市南沙区人民法院出台的《互联网电子数据举证、认证规程(试行)》,系广东省首个电子数据规程,但是存在一些不足。互联网电子数据举证涉及证据失权、举证内容以及证明妨碍等内容。认证依赖于对互联网电子数据的真实性、完整性、关联性等审查作出事实认定。完整性依赖于互联网电子数据内容的完整性,数据载体的完整性和数据系统环境的完整性。关联性要构建虚拟世界和现实世界的联系,实名制是互联网电子数据关联性的重要识别方式。认证过程可能还需要借助专家的帮助。

Nansha Court of Guangzhou issued the Internet Electronic Data Proof and Attestation Regulations(Trial)On May 21,2018,which is the first electronic data regulations in Guangdong Province,but there are some shortcomings.Internet electronic data proof involves evidence disqualification,proof content,proof obstruction and so on.The process of attestation depends on the factual determination of the authenticity,integrity,relevance of Internet electronic data.The evaluation of authenticity and integrity depend on the integrity of the electronic data,data carriers and the data system environment.The connection between the virtual and the real world should be established in order to satisfy its relevance.The real-name registration stipulation serves an important way to identify the relevance of Internet electronic data.Those processes above may also requires the help of experts,which requires the judges get hold of the initiative to evaluate the evidence.
