自然权利的“自然”研究

Study on "Nature" of Natural Rights

自然权利作为一个概念由"自然"与"权利"两个部分组成,诸多研究自然权利的作品着眼于权利(right/ius)的含义,但自然(nature)却很少得到关注。为了完整、准确理解"自然权利"的含义,还需要探寻"自然"的含义(三重意涵)以及"自然权利"的"自然"的含义。通过梳理,可以发现自然权利的"自然"的演绎基础与路径:"自然权利"、现代权利、人权以及其他权利观念是社会建构,甚至是故事叙事的结果。这种社会建构与故事叙事推动权利概念(包括自然权利)顺遂自然的概念渐次发展,在变与不变的本质(nature)上结合自然的三种意涵,不断谱写新的"权利"的故事。

As a concept,natural rights are composed of"nature"and"right".Many works on natural rights focus more on the meaning of right/ius,but little on"natur".In order to fully and accurately understand the meaning of"natural rights",it is necessary to explore the meaning of"nature"(triple connotation)and the meaning of"nature"of"natural rights".The analysis can reveal the deductive basis and path of"nature"of natural rights:natural rights,modern rights,human rights and other rights concepts are the result of social construction,even story narration.This kind of social construction and story narration promotes the concept of right(including natural rights)to develop smoothly and gradually,and constantly composes new"right"stories by combining the three connotations of nature with the nature of variable and invariabe.
