摘要
2020年之前的党内法规研究整体上属于立规论研究范式,对党内法规制度体系的建立、立规质量的提升和社会共识的形成发挥了重要助推作用。站在中国共产党诞生百年的历史新起点,基于党内法规制度自身建设、落地生根及其与国家法律和谐关系的维系,党内法规研究需要及时转向释规论研究范式。党内法规释规论研究范式应重点解决好主体论和原则论两大问题,构筑理想的党内法规释规论理论图景,阐释好中国特色社会主义法治体系的基本原理。
The research of inner-party laws and regulations before 2020 belongs to the research paradigm of legislation,which played an important role in promoting the establishment of inner-party laws and regulations system,the improvement of legislation quality and the formation of social consensus.Viewed from the new historical starting point of one hundred years since the birth of the CPC and based on the self-construction of the inner-party legal system,its root and the maintenance of the harmonious relationship with the national laws,the research on the inner-party laws and regulations needs to turn to the paradigm of interpretive theory in time.The research paradigm of the interpretation of inner-party laws and regulations should focus on solving the two major problems of the subject theory and the principle theory,constructing an ideal theoretical prospect of the interpretation of inner-party laws and regulations,and explaining the basic principles of the socialist legal system with Chinese characteristics.
