新时代“枫桥经验”视域下的社会化协同执行机制——基于J省法院的实证研究

The socialized cooperative execution mechanism from the perspective of “Fengqiao Experience” in the new era ——An empirical research based on J provincial court

党的十九届四中全会提出,完善共建共治共享的社会治理制度,构建正确处理新形势下人民内部矛盾的有效机制,坚持和发展新时代"枫桥经验"。人民法院在社会治理中扮演重要角色,执行工作是实现实体正义、兑现胜诉利益的最后一环,而"执行不能"、执行不规范、消极执行等问题极易诱发和激化新的社会矛盾。在"后新冠时期"诉讼激增、生效裁判文书自动履行率下降的严峻形势下,应把握新时代"枫桥经验"的理论精髓,实现"切实解决执行难"和善意文明执行的平衡,促进执行工作法律效果和社会效果的统一,探索构建具有中国特色的社会化协同执行机制。

The Fourth Plenary Session of the 19th CPC Central Committee proposed to improve the social governance system of co-construction,co-governance and sharing,build an effective mechanism to correctly handle contradictions among the people under the new situation,and adhere to and develop the"Fengqiao Experience"in the new era.The people’s court plays an important role in social governance.Execution is the last link to realize substantive justice and realize the interests of winning a lawsuit.However,problems such as"unable to execute",nonstandard execution and negative execution can easily induce and intensify new social contradictions.In the period of post-corona-virus epidemic,lawsuits are increasing rapidly and the automatic performance rate of effective judgment documents is declining.Therefore,we should grasp the theoretical essence of"Fengqiao Experience"in the new era,realize the balance between"effectively solving the difficulty of execution"and good faith civilized execution,promote the unification of legal effect and social effect of execution,and explore the construction of socialized collaborative execution mechanism with Chinese characteristics.
