对《学位条例》修订的若干思考

Some Reflections on the Revision of the Regulations on Academic Degrees

《学位条例》是我国第一部教育法律,在依法推进学位与研究生教育进程中意义重大。然而随着时代发展,《学位条例》面临一系列重大挑战,现正处于全面修订为《学位法》的重要阶段。《学位条例》实施过程中产生的法律纠纷主要包括三种类型,分别涉及学位授权审批、学位授予标准和学位授予程序。《学位条例》的修订应当紧跟经济和社会发展需要,回应现实法律纠纷,在保护学位申请人权利、明确学位管理体制、完善学位类型和条件、规范学位授权和授予程序,以及加强学位质量保障等方面进行重点调整,以更好地规范学位授权审批和学位授予行为,保护学位申请人的合法权益。

As the first legal provisions in education of China,Regulations of the People’s Republic of China on Academic Degrees is of great significance in the process of advancing degree and graduate education in accordance with the law.However,with the development of the times,the Regulations on Academic Degrees has been facing a series of major challenges and is currently at an important stage of comprehensive revision into the Academic Degrees Law.The legal disputes arising from the implementation of the Regulations on Academic Degrees mainly include three types:the disputes on the approval of degree authorization,the disputes on the standards of degree conferment,and the disputes on the procedures of degree conferment.The revision of the Regulations on Academic Degrees should echo the needs of economic and social development,respond to the real legal disputes,and make key adjustments in protecting the rights of degree applicants,clarifying the degree management system,improving the types of degrees and conditions of conferment,regulating the procedures of degree authorization and conferment,and strengthening the quality assurance of degrees,so as to better regulate the practice regarding to the approval of degree authorization and degree conferment,and to protect the legal rights and interests of degree applicants.
