论中国司法实践中信赖原则法理适用之可能——以医疗垂直分工及其过失犯罪为视角

On the Possibility of Applicability of the Principle of Reliance in Chinese Judicial Practice——On the Basis of Medical Negligence

在医事法律运用与临床医疗实践相互影响的过程中,基于职业立场、知识背景、实践经验等因素的不同,对于医疗分工、医事监督、信赖原则适用等问题,法律专业工作者与医疗专业工作者可能持有彼此各异的实务观点与实践认识。除了对相关法学文献以及司法判决案例等进行理论分析与研究外,有必要通过法律实证分析方法进一步加以研究。这是刑法理论界首次在全国范围内对相关专业人员进行问卷调查。从所示的数据来看,大多数参与的医务工作者对医疗过关相对宽容,而司法实务界却持谨慎态度。此次问卷调查及统计分析,更加深刻地揭示了目前中国司法实务界与医学界对于同一问题之处理,依据不同立论基础所采用的不同思维、方法与态度,并阐释了其原因。

Here is about the empirical legal study on the application of the principle of reliance in medical malpractice.Because of the difference in background,knowledge and experience,in the process of interactions between the application of the medical laws and clinical practice,the legal and health professionals can hold different practical ideas and points when they talk about the medical division,supervision as well as the application of the principle of reliance.Therefore,in addition to the analysis and research of related legal literature and judicial decisions,we should conduct an empirical legal study to find more value that can be found and acquired only by the objective analysis of statistics.With the survey in Chinese Mainland,we firstly found that the majority of participants hold a relatively large tolerance toward a medical negligent offender.Nevertheless,Chinese legal professionals are prudent in accepting the application of the principle of reliance in medical malpractice.Through the survey and the objective analysis of statistic,we found that the judicial and medical groups have very different thoughts,thinking methods as well as attitude,even if they face the same problems.
