面对我国传统文化长期保持无形形态、版权主体薄弱、文化资源分散等局限,版权保护和传统文化发展陷入僵局。而随着二十大报告重视文化强国建设,并提供了国家文化数字化战略解决方案,传统文化迎接数字化转型新发展。文化数字化在构想与实践中逐渐成为传统文化实现版权保护的合理选项,将漂移的传统文化固定为具有独创性和“一定形式表现”的智力成果,为成为版权作品提供了可能性。除了作品之外,讨论作者也尤为重要,从多元建设主体参与到政府版权主体主导公共数据归属,将提高传统文化的丰富性、安全性和稳定性。最后,还需站在更长远的角度构想对数据库授权与管理规范化,为后续文化发展提供保障。上述每一步的转化蕴含着巨大的传统文化的数字版权机遇,推动着我国传统文化的传承与传播发展,以及为传统文化“走出去”,面向国际市场夯实基础,以期尽早实现文化强国目标。
