《电子商务法》所规定的平台责任,主要针对电商平台,但现实生活中存在各种类型的平台,它们与电商平台既有相似性也有较大差别。将《电子商务法》上关于平台责任的规定,适用于其他类型的平台,需要根据平台所从事的具体行为,所采用的商业模式,平台运行的技术特征,平台对于平台上的信息的控制力等因素,来决定其承担平台责任的合理边界。平台是一种新类型组织体,在确定平台责任边界的时候,需要遵循平台自身的逻辑,特别需要注意平台责任与相关联法律制度之间的差别。

The platforms’responsibilities stipulated by the Electronic Commerce Law are mainly aimed at the responsibilities of the e-commerce platforms.However,there are various types of platforms in real life and there are both similarities and significant differences between these platforms and the e-commerce platforms.When the provisions on the platforms’responsibilities in the Electronic Commerce Law are applied to other types of platforms,we should decide the reasonable boundary of platform responsibility taken by these platforms according to the specific activities of these platforms,business models adopted by them,technical features of platform operation,and the control over the on-platform information by these platforms,etc.The platform is a new type of organization.In order to determine the responsibility boundary of the platform,we need to follow its own logic,especially paying attention to the relationship between platform responsibility and relevant legal regimes.
