纪检监察工具论

On the Instrumentalism of Discipline Inspection and Supervision

纪检监察机关根据党风廉政建设和反腐败工作需要,不断开发纪检监察工具。从治理工具视角,纪检监察工具可以划分为两类:常规型、专项型。作为控制工具的常规型纪检监察工具,应用于经常性工作。作为导向工具的专项型纪检监察工具,聚焦于专项治理。新时代以来,纪检监察工具发展并形成了"常规型+专项型"工具相配合的"常专结合"反腐败模式。党的十八大时期,常规型工具快速迭代,专项型工具不断强化,服务于夺取反腐败斗争压倒性胜利。党的十九大时期,常规型工具在前期建构的框架中运行调适,专项型工具更加丰富,服务于"三不一体"体制机制建设。两类工具相互配合呈现出更好的反腐败效果。发展探索纪检监察工具理论有利于实现党内法规同国家法律的衔接和协调,有利于提升纪检监察制度建设的体系化水平,有利于提升纪检监察工作实效,有利于国家治理体系和治理能力现代化。

The Central Commission for Displine Inspection(CCDI)and the National Supervisory Commission(NSC)continuously develop the tools of discipline inspection and supervision according to the needs of the construction of Party conduct and of an honest and clean government and anti-corruption.From the perspective of governance tools,tools of discipline inspection and supervision can be divided into two types:conventional and special.The conventional tools are used in regular work while the special tools focus on special governance.Since the new era,the tools of discipline inspection and supervision have developed and formed the anticorruption mode of"combination of conventional and special tools".During the 18 th National Congress of the Communist Party of China(CPC),conventional tools iterated rapidly and special tools have been continuously strengthened to serve the overwhelming success in the fight against corruption.During the 19 th National Congress of the CPC,the conventional tools were adjusted in the framework of early construction.There are more special tools serving the construction of"Three no-corruptions in integration"system and mechanism.The two kinds of tools cooperate with each other,showing a better anti-corruption effect.The development and exploration of the theory of tools of discipline inspection and supervision is conducive to the realization of the cohesion and coordination between the inner-Party laws and regulations and national law,to improving the systematic level of discipline inspection and supervision system construction,to improving the effectiveness of discipline inspection and supervision,and to the modernization of national governance system and governance capacity.
