党内法规与国家法律关系研究的理论演进——基于研究进路的梳理

The Evolution of Theories about the Relationship between Party Regulations and National Laws——A Summary Based on Researching Methods

回顾以往有关"党内法规与国家法律关系"这一命题的理论成果可知,相关研究已形成政策叙说、理论建构和规范分析三种主要进路。政策叙说类的研究以党的领导人的政策表述与党的政策文本为研究对象,围绕党内法规与国家法律的制度定位关系和约束力关系展开,旨在证成和宣传政策背后的基本立场。理论建构类的研究通过引入或构建某种理论框架,形成了党内法规与国家法律之间的二元关系、属性关联、效力边界、约束力关系的正当性等问题的理论表达,展现着学界构建党内法规理论基础的自觉。规范分析类的研究以党内法规和国家法律的规范文本为研究对象,围绕党内法规与国家法律在宏观层面的总体性衔接协调问题、在中微观层面的领域性衔接协调问题展开研究。在这一理论命题的研究中,三种研究进路立基于不同的理论与实践背景,各有优劣、各有侧重,共同致力于形成对党内法规与国家法律关系命题的充分诠释。

A review of the previous theoretical achievements on the topic of the"Relationship between Party Regulations and National Laws"shows that,the relevant researches have formed three main different researching ways:interpretation on policy,theoretical construction,and normative analysis.The researches by interpretating policy take the political statements of the Communist Party of China’s(CPC)leaders and the political texts of the CPC as the object,and center on the relationship of institutional positioning and binding force between Party regulations and national laws,aiming at proving and publicizing the basic standpoints behind the policies.By introducing or constructing a certain theoretical framework,the researches of theoretical construction have formed the theoretical expression of such issues as"the dualistic relationship""the attributive correlation""the boundary of force"and"the legitimacy of relationship on binding force between Party regulations and national laws,and shown the consciousness of academic community in constructing the theoretical basis of inner-Party laws and regulations.The researches of normative analysis take the normative texts of Party regulations and national laws as the object,and focus not only on the overall cohesion and coordination between Party regulations and national laws at the macro level but also on the specific domains at the medium and micro level.In the study of this theoretical proposition,the three researching methods are based on different theoretical and practical backgrounds.Each of them has its own advantages and disadvantages,and each has its own emphasis.They are all committed to forming a full interpretation of the proposition of the relationship between Party regulations and national laws.
