党内法规研究的“三阶”理论——以党内法规效力渊源研究为例

On the Theory of “Three Levels” in the Study of Inner-Party Laws and Regulations——Taking the Study on Source of Effectiveness of Inner-Party Laws and Regulations as Example

党内法规理论体系建设,必须在对法学传统理论进行扬弃的基础上完成,具体分为三个阶段:一是论阈框定,从法学传统理论出发,从而找出研究的"真问题";二是话语形成,就是结合党内法规,选择理论工具、方法,找出问题研究的分析路径;三是价值分析,就是用价值分析方法修正理论模型,调整价值上的冲突抵牾。党内法规效力问题研究同样分为三阶:第一阶,框定党内法规效力渊源问题的基本论阈;第二阶,运用上位概念"法"解决效力渊源问题;第三阶,充分考虑法治的价值目标与中国共产党的价值追求,对之前选择的话语是否妥当进行反思与审视。

The construction of the theoretical system of inner-Party laws and regulations must be completed on the basis of suiting and discarding traditional theories of law,which could be further divided into three stages.The first is to frame the threshold,finding out the"true problem"of research from traditional theories of law.The second is to form the discourse,which means choosing theoretical tools and methods and finding out resolution paths of the problem combined with inner-Party laws and regulations.The third is to analyze the value,which is to use the value analysis method to correct the theoretical model and resolve conflicts on the value.The study on the effectiveness of inner-Party laws and regulations can also be divided into three stages.The first is to frame the threshold of the problem.The second is to use"law",the upperseat concept of inner-Party laws and regulations,to solve the problem.The third is to reflect and examine whether the previous choice of discourse is appropriate by fully considering the goal of rule of law and the pursuits of the Communist Party of China.
