违反党纪行为的构成要件研究

On Constitutive Elements of Acts Violating Party Discipline

由于《中国共产党纪律处分条例》没有具体规定违反党纪行为的构成要件,学界也尚未形成规范化的违反党纪构成要件理论,实践中对违反党纪行为的认定存在定性不准确的问题。因此,有必要借鉴犯罪构成四要件理论和行政违法构成要件理论,正确把握违反党纪行为的客体、客观方面、主体以及主观方面要件。构建违反党纪构成要件理论对明确监督执纪依据、精准处分违反党纪行为、实现纪法有效衔接具有重要的现实意义。实践中认定违反党纪行为的难点在于违反党纪行为与正当行为、违反其他纪律行为、违法行为、犯罪行为的区分,解决这一问题的出路为准确界定不同行为各自的构成要件。

Since the Regulations on Disciplinary Actions of the Communist Party of China does not specify the constitutive elements of the acts violating Party discipline,of which the standardized theory has not yet been formed in the academic circle,the determination of acts violating Party discipline is not accurate in practice.In order to correctly grasp the elements of object,objective aspect,subject and subjective aspect about the acts violating Party discipline,it is necessary to draw lessons from the theory of"four constitutive elements of crime"and"the constitutive elements of administrative violations".It is practically significant to construct the theory of constitutive elements of acts violating Party discipline for clarifying the basis of supervision and accountability,accurately punishing acts violating Party discipline and establishing effective linkages between Party discipline and laws.Difficulties in determining acts violating Party discipline lies in distinguishing acts violating Party discipline from legitimate behaviors,acts violating other disciplines,illegal behaviors and criminal behaviors.The only solution to solve this problem is to accurately define the constitutive elements of different acts.
