党内规范性文件在法治社会建设中的作用及实现——基于社会组织与其成员关系的视角

The Function and Realization of Inner-Party Normative Documents in the Construction of Society under the Rule of Law——From the Perspective of Relationship between Social Organizations and Their Members

建设法治社会就是要实现公权力运行系统之外的社会生活的法治化。党内规范性文件是特定党组织制定的具有普遍约束力并可反复适用的重要文件,显著的效力"外溢"和灵活便利的特点与法治社会建设的现实需求不谋而合。克服社会组织的行政化倾向,激发社会组织的创造活力;弥补社会立法不足,健全社会法治体系;推动社会治理现代化,实现社会组织自治,是党内规范性文件在社会组织与成员关系法治化过程中发挥的重要作用。作用的发挥需要党内规范性文件在制定、审查、宣传等方面进一步完善,更需要通过加强党的领导将党的意志贯穿社会组织建设的始终,突出党的领导在法治社会建设中的制度优越性。

To build a society under the rule of law is to realize the social life outside the public power operation system under the rule of law.Inner-Party normative documents are important documents formulated by specific Party organizations,which are universally binding and can be applied repeatedly.The notable"spillover"effects and the characteristics of flexibility and cheapness coincide with the practical needs of the construction of society under the rule of law.It is the important function of inner-Party normative documents in the process of promoting the relationship between social organizations and their members under the rule of law,to overcome the administrative tendency of social organizations and stimulate the creativity of them,to make up for the lack of social legislation and improve the social legal system,to promote the modernization of social governance and realize the autonomy of social organizations.In order to realize the function of inner-Party normative documents,we should further improve the formulation,review,publicity and other aspects of them,guarantee Party will’s penetration of the construction of social organizations by strengthening Party leadership,and highlight the system superiority of Party leadership in the construction of society under the rule of law.
