基于党规本原属性的党规国法“衔接和协调”原则研究

Research on the Principle of Coordination Between Party Regulations and National Laws-Based on the Nature of Party Regulations

在全面依法治国和全面从严治党的新时期,"衔接和协调"成为党内法规与国家法律发展的基本目标定位。党的六届六中全会确立党内法规维护党中央权威和集中统一领导及全党义务服从本位的两大本原属性,由此形成党内法规与国家法律在法律性质上的显著差异。中华人民共和国成立后党规国法关系演变史表明,党内法规与国家法律既不能互相代替,也不能彼此割裂,衔接协调才是两者关系的科学定位。整体来看,党规国法衔接协调应该遵循党规坚守自身本原属性的同时,积极借鉴国法法治理念精神的整体原则,具体应该从强化党中央集中统一领导、突出对公共权力运行监督和重视党员权利保护、关注党内程序法完善层面工作的积极推进,真正实现党规国法的衔接协调,确保全面从严治党和全面依法治国事业顺利开展。

In the new era of fully advancing law-based governance and rigorous governance over the Party,"coordination"has become the development goal of Party regulations and national laws.The Sixth Plenary Session of the 6 th CPC Central Committee has successfully summarized the two characters of inner-Party laws and regulations,including the guarantee of authority and leadership of CPC,and the standard of obligation for the whole Party,which show the significant differences between Party regulations and national laws in the legal nature.The history of the relationship between Party regulations and national laws reflects that they can neither replace each other nor be separated,and the coordination is their appropriate relationship.Overall,it’s necessary to follow the principle that Party regulations should adhere to their own nature and learn from national laws,in order to fully exercise law-based governance and rigorous governance over the Party.Specifically,on the one hand,we are supposed to strengthen the centralized and unified leadership of the CPC Central Committee and emphasize the supervision on public power;on the other hand,we ought to attach great importance to the protection of Party members’rights and pay close attention to the improvement of inner-Party procedural regulations.
