论党内规范性文件概念及其类型限缩

On the Concept of Inner-Party Normative Documents and the Limitation of Their Types

党内规范性文件区别于党内法规,是中国共产党管党治党的重要规范之一。目前党内规范性文件的概念,以及其类型过于宽泛复杂,在实践和理论上存在诸多不足,这不利于党内规范性文件的科学化发展以及适应完善党内法规制度体系的内在要求。本文通过揭示《中国共产党党内法规和规范性文件备案规定》第二条定义"党内规范性文件"概念时的兜底功能定位,反思其对准确定义党内规范性文件概念形成的限制作用,并以党内法规制度体系视角对目前党内规范性文件的类型进行限缩,分离出"党的主张类文件""类党内法规""党内法规解释"三类规范,进而将党内规范性文件类型限定为实施类规范和探索类规范,最后明确党内规范性文件是指中国共产党各级组织及其部门为贯彻实施党的规定要求或先行补充党内规范,在履行职责过程中针对党组织的工作、活动和党员行为制定的以特定公文为载体的行为规范。

Different from inner-Party laws and regulations,inner-Party normative documents are important norms for the Communist Party of China to govern the Party.At present,the concept and types of inner-Party normative documents have many shortcomings in practice and theory,which are not conducive to the scientific development of inner-Party normative documents,and not favourable for the inherent demand of perfecting inner-Party laws and regulations system.Having defined the concept of"inner-Party normative documents",Article 2 of the Regulations on the Recording of Inner-Party Laws and Regulations and Normative Documents of CPC is actually strangling the precise definition of them.From the perspective of inner-Party laws and regulations system,we can limit inner-Party normative regulations to three types,including"propositional documents of the Party","analogues of inner-Party laws and regulations"and"interpretation of inner-Party laws and regulations".The types of inner-Party normative documents are supposed to be further limited to the implementary norms and the exploratory norms.Finally,the concept of inner-Party normative documents can be defined as the code of conduct for the work and activities of Party organizations and the behaviours of Party members,which is formulated by different organizations and departments of CPC in the process of performing duties,so as to implement the requirements of the Party and supplement inner-Party laws and regulations in advance.
