法律诊所教育视角下的民事诉讼法学教学方法的创新策略初探 被引量:1

摘要 法律诊所式教育最早发源于美国,是法律实践性教育的经典模式之一。民事诉讼法在法学学科中是一门实践性与应用性较强的学科。借鉴诊所式法律教育的内容有利于完善我国传统的教学方法,但在我国当前的法律教学中,有许多资源上与制度上的阻碍。近年来,法学教育也在不断地进行教育改革,民事诉讼法是当前法学核心主干的主要课程之一,各大院校的相关法律学院也在与时俱进,根据时代对法学的要求,进行不断的教学改革,不断的尝试新的改变,从而对法学进行有益的尝试。在法学的教学过程中,要不断地坚持以学生为主体地位,从而进行互动式的教学模式,要从学生们自主学习平台与当前的师资力量、相关的课程教育模式等方面为学生最大程度上提供互动式民事诉讼课堂的相关教学平台,从而有利于学生们形成法律思维,从而提高法律的相关技能,促进当前学生们的法学相关教育。有利于以后同学们在法律方面的职业就业。 Legal clinic education originated in the United States and is one of the classical models of legal practice education.The Civil Procedure Law is a practical and applicable subject in the law discipline.Drawing lessons from the contents of clinical legal education is beneficial to the improvement of traditional teaching methods in China,but there are many resource and institutional obstacles in the current legal teaching in China.In recent years,legal education has also been constantly undergoing educational reform,and the Civil Procedure Law is one of the main courses of the core legal backbone at present.The relevant law schools in major universities and colleges are also advancing with the times and carrying out continuous teaching reforms in accordance with the requirements of the times for law.Try new changes ceaselessly,thus carry on the beneficial attempt to the law.In the course of law teaching,we must constantly adhere to the student as the main position,so as to carry out interactive teaching mode.It is important to provide students with the most interactive teaching platform in the civil litigation classroom in terms of their own learning platform and the current teachers ‘strength and relevant curriculum education model,so as to help students form legal thinking.In order to improve the relevant skills of the law and promote the current students ‘law-related education.It is conducive to students ‘professional employment in the law.
