论中国自贸试验区投资便利化的法治路径

中国自贸试验区拟打造的营商环境目标之一就是“便利化”。“便利化”既包括贸易便利化,又包括投资便利化,其中投资便利化广义上可包括投资自由化。中国自贸试验区十年的建设中,通过在投资便利化方面采取“负面清单”准入模式,提高了外资投资进入的便利性、行政管理措施的可预见性和效率。为了对接更高标准的投资便利化水平,中国自贸试验区还应积极对接正在形成的WTO《投资便利化协定》下的规则。对此,中国自贸试验区可着力提升外商投资营商环境的透明度措施,协调更简化和更便捷的投资行政管理程序,在追求便利化的同时仍要兼顾安全化。

One of the goals of improving business environment in China's FTZ is facilitation,which includes trade and investment.The investment facilitation also generally ineludes investment liberalization.During the last ten years"FTZ"development,the"negative list"has been adopted to improve the facilitation of foreign investment entry and the predictability and effciency of administrative measures.To be benchmarked against the higher standards for investment facilitation,China's FTZ should also align its development with the on-going Investment Facilitation Agreement proposed by the WTO.In this regard,China's FTZ may pay special attention to taking measures to improve the transparency of foreign investment policy,make efforts to make the administrative procedures on investment more streamlines and convenient,and ensure security at the same time.
