论中国自贸试验区法治的性质

自贸试验区法治具有如下性质:其一,战略性。自贸试验区承担着国家治理现代化、制度型开放、全面依法治国等重大国家战略任务,使得自贸试验区法治具有战略性。其二,试验性。自贸试验区“先行先试”的改革定位、改革措施的强烈时效性以及复制推广机制的设立,决定了自贸试验区法治的试验性。其三,创新先行性。自贸试验区创新先行的改革要求、创新先行的具体制度的创设、创新先行的立法保障机制以及鼓励创新、宽容失败机制的设立,决定了自贸试验区法治的创新先行性。其四,自主性。自贸试验区改革主动对标高标准国际经贸规则,各地自贸试验区具有自主改革权,使得自贸试验区法治具有自主性。自贸试验区法治性质,决定了自贸试验区法治在当代中国法治体系中的地位及其功能发挥。
