统一法治背景下的法治高地建设

法治高地是地方法治建设的新阶段,是多方面或某方面的领跑者、先行者,是经济发达地区的内生规则。法治高地建设既是基于国家鼓励地方建设更高标准的法治而展开的法治竞争,也是基于国家特别授权所进行的法治先行先试。基于法解释学的立场,为解决法治高地所引发的法治“木桶效应”,有必要拓展行为地管辖的联结点,建立跨行政区协议管辖和经当事人同意的跨行政区管辖,从而适当扩大其地方性法规的适用范围,避免法治高地被拉低的风险。法治高地的经验在应然意义上是全国各地的共同法,是其他地方的可复制经验。为此,法治高地建设的经验应作为示范性法治在全国其他地方积极推广,并在条件成熟时上升为全国性立法,从而推动我国法治整体水平的提升,从根本上消除“木桶效应”。

Rule of law highland construction is a new phase of local rule of law development.It is a forerunner and inherent to the developed areas in China.It is a race when the state encourages the local areas to develop high-standard rule of law and also a pilot program under special central authorization.From the perspective of legal hermeneutics,it is necessary to expand the connection of jurisdiction of the place of act and establish the jurisdiction on agreement across the administrative areas and the cross-administrative-area jurisdiction upon the party's consent so as to properly expand the application scope of local regulations and address the issue of barrel effect.The experience from it constitutes the conmon law across the country in a positive point,which can be reproduced by other areas.In this case,these experience should be actively promoted as the model rule of law practices,and then upgraded to national legislation if the circumstance permits to improve the overall rule of law in China and eliminate the barrel effct.
