基本文化权益保障的信任共识论

基本文化权益保障往往通过发展公益性文化事业,来达成对不同文化需求的个体认同、彼此承认乃至组织行动的信任共识。其通常依托公共文化服务供给规范的效能化行为指引,来提升当事人组织行动的信任共识程度,以最优化满足公民的基本文化需求。抽象信任、普遍信任与弱信任作为法律信任思维所呈现的规范特性,有必要基于此分别厘清公共文化服务供给规范所涉治理模式、资金管理与设施管理事项的信任要义。进而设定相应的外部、内部与主体之开放式行为交往指引,投入结构、用途管制之规则式物质保障指引,场所、服务与监督之普遍干预式行为评判指引,以类型化型塑实现公共文化服务科学化、功能化与绩效化供给的规范进路。最终通过明晰公共文化服务效能化供给,来强化基本文化权益保障所达成的信任共识。

The basic cultural right and interest protection is ensured through developing public cultural undertakings so as to achieve the individual recognition among different cultural demands,mutual cognition and trust consensus in organizational activities.It often follows the guidance of the norms on public cultural supply to improve the turst consensus in the actions of the parties'organizations and best meet the basic cultural demands.Considering the normative features of abstract trust,general trust and weak trust in the logic of legal trust,it is necessary to define the meaning of trust in the governance models,fund management and facility administration from the norms on public cultural service provision.Then,it is necessary to set out the open behavioral guidelines on external,internal and subject exchanges,rule-based material guidelines on regulating the input structure and utilization control,and general intervention-based behavioral guidelines on evaluating the premise,service and supervision to shape a scientific,functional and performance-based provision of publie cultural service in a typological way.Finally,it is necessary to define the provision effectiveness of public cultural services to strengthen the trust consensus reached in the protection of basic cultural rights and interests.
