涉外法治视野下“一带一路”国际规则的建构

坚持国内法治与涉外法治的统筹推进,加快构建涉外法治工作战略布局,是习近平法治思想的核心要义。“一带一路”倡议十年来,经历了理念提出、早期收获,目前步入了规则建构的关键阶段。推动共建“一带一路”高质量发展,需要把握“一带一路”国际规则建构面临的特殊性与新要求,实现规则的“软联通”。与一些区域性国际规则的建构路径不同,在“一带一路”国际规则建构中,应重视“软法”建设,旨在反映各方可持续发展需求,避免过多触碰各方国内“硬法”;应重视投资法律体系的完善,为妥善解决投资争端进行规则安排;应从局部到整体、按照先易后难,推进共建国家双边、区域法治示范区的建设,而非强调“一揽子”协定的快速达成;应强调规则的包容性,寻求各方制度的“最大公约数”而非“最高标准”。推进“一带一路”国际规则建构,形成符合各方利益的规则体系,有助于降低国际贸易和投资风险,推动构建人类命运共同体,是中国式现代化建设的内在要求和题中之义。

It is the essential feature of Xi Jinping Thought on Rule of Law to take a coordinated approach to domestic rule of law and international rule of law and quicken the strategical layout of the international affairs.The eritical juncture of the tenth year of Belt and Road Initiative is from concept proposal,early harvest to rule construction.It is important to grasp the special aspects and new demands when constructing the international rules and achieve"soft connectivity"of rules to boost its quality development.Compared with routine regional international.rules construction,it is imperative to emphasize the following aspects:the formulating of soft laws to reflect all the parties'sustainable development and avoid the conflicts with their hard laws;the improvement of investment law system to properly handle the investment disputes;the adoption of a step-by-step approach to promote the demonstration area construction of bilateral and regional rule of law,instead of emphasizing the rapid conclusion of"package"agreements;the inclusivity of rules and the greatest consensus rather than the highest standards of rules.The construction of Belt and Road international rules and the rule system that suit the parties interest can reduce the international trade and investment risks and promote the shared destiny,which is also essential for the Chinese modernization.
