全过程人民民主的宪法逻辑

作为中国式现代化本质要求之一的“全过程人民民主”属于宪法上人民民主的原则与精神的范畴。在中国共产党长期的革命与执政实践中,民主在宪法上形成了从立党之基到执政基本方式的特定政治与历史逻辑,新时代以来逐渐凝练出“最广泛、最真实、最管用”的核心内涵并体现为宪法上的理论逻辑。厘清民主与法治、发展、治理的辩证关系,更好发挥人民代表大会制度对全过程人民民主的重要载体作用,构成宪法上的制度与实践逻辑。在坚持依宪治国、依宪执政中必须深刻厘清民主对于法治的根基作用,对于发展的动力作用,以及对于治理的制度作用。总而言之,以法治方式、在宪法轨道上推进全过程人民民主,民主始终是最核心的内容。

The whole-process of people's democracy,one of the essential requirements of Chinese modernization,belongs to the principles and spirit of people's democracy in the constitution.In the long-term practice of revolution and governing of the Communist Party of China,democracy has constitutionally formed a specific political and historical logic from the foundation of the Party to the basic means of governing.Since the new era,the core connotation of"the broadest,the truest,and the most effective"has been gradually condensed in the theoretical logic of the constitution.It is the constitutional logic of the system and practice to clarify the dialectical relationship between democracy,rule of law,development and governance,and to give better play to the role of the people's congress system as a vehicle for the whole-process people's democracy.In adhering to the principle of constitution-based governance,it is necessary to deeply clarify the fundamental role of democracy in the rule of law,its driving force for development,and its institutional role in governance.Democracy has always been the core for promoting the whole-process people's democracy through the rule of law and the constitution.
