以人民为中心视域下中华法系的创造性转化

On the Creative Transformation of Chinese Legal System: A People-Centered Perspective

以人民为中心与中华法系中“民为邦本”的传统法律文化一脉相承,都重视法律对“人”的关照。“人”是推动中华法系创造性转化的重要方面,能够为法治现代化注入中国的文化基因。为此实践目标,需要挖掘中华法系中法律是如何认识“人”、如何体现“人”的,并在此基础上推动“人”的创造性转化。立足中华法系中“人”的原初意义,梳理历史进程中“人”的嬗变,发现“人”的变与不变。建设以人民为中心的法治中国,需要运用变与常的创造性转化逻辑,坚持法律重视“人”的本质和人性、体现“人”的人性、人情并塑造人的品格;从“人”的认识出发,赋予“人”适应时代的科学内容;从法律对“人”的体现出发,建构体现“人”的良法,追求实现“人”的善治。

The people-centered legal culture is related to"taking the people as the foundation of the nation"in the Chinese legal system.both of them pay attention to the"human"in law."human"is an important aspect of promoting the creative transformation of Chinese legal system,and can inject Chinese cultural gene into the modernization.For this practical goal,we need to explore how the law in the Chinese legal system understands and embodies"human",and promote the creative transformation of"human"on this basis.Based on the original meaning of"human"in Chinese legal system,this paper combs the evolution of"human"in the historical process,and finds that"human"changes and remains unchanged.In China,in order to build a people-centered rule of law,we need to use the creative transformation logic of change and constancy,pay attention to the human essence and humanity,reflect the humanity,human feelings and shape people’s character;endow"human"with modern and scientific content,construct a good law reflecting"human"and pursue a good governance.
