Behind the ban of TikTok,it not only reflects America’s ambition of data dominance in the context of the Sino-US game,but also reflects the challenge and risk that new technology poses to current legal rules and regulations.Facing the current dilemma,Chinese corporations should safeguard their rights and interests in compliance and litigation,and China is supposed to protect domestic corporations and strive for the dominant position of the data game in support and opening up.Although the technological innovations represented by TikTok may cause incompatibility,effective legal creation,interpretation,and application can regulate them.Furthermore,the inherent contradiction between law and science and technology will intensify with the further development of science and technology.Given that,simply imposing the death penalty for technology is not conducive to the development of society and the maintenance of legal order.Instead,an inclusive legal system will be imperative to the Rule of Law.
