论香港立法会制约“拉布”的法理基础与实践进路

The Legal Foundation and Practice Approaches of the Restriction of Filibuster by the Legislative Council of Hong Kong

关于香港立法会"拉布"的制约问题,一直存有争议。从历史上看,"拉布"是香港民主政治制度发展过程中的产物。本文聚焦于制约"拉布"的法理基础与实践进路,通过分析"拉布"的历史源流、法律基础及其在香港立法会审议实践中的具体表现和危害,回应限制动议、剪布权及《议事规则》修订等方面的治理措施在实践过程中所遭受的质疑,从而论证制约"拉布"及相关具体制度的法理正当性。

The restriction of filibuster of the Hong Kong Legislative Council has always been in controversy.From historical perspective,filibuster is the product of the development of Hong Kong’s democratic political system.This paper focuses on the legal foundation and practice approaches of the restriction of filibuster.In order to demonstrate the legitimacy of the Restriction of Filibuster and related specific systems,the author not only analyzes the historical origins,legal basis,specific manifestations and harms of filibuster of the Hong Kong Legislative Council,but also responds to the challenges of the governance measures in the course of practice,such as restricted motions,the right to end the debate,the revision of the rules the procedure.
